WHAT IS THE SERVICE
The Service is intended to allow users to provide safety reports regarding their own perceptions and experiences concerning public areas like roadways, trails and parks. Location information collected by the application is recorded by the application and included in the safety report. Before a safety report is submitted the user has the option to save the report in the user cell phone device and/or forward the report via email to third parties. The submitted reports are coded on a map according to the available identifiable location data and are posted on a discussion board, both maps and discussion boards are public and accessible to the public. The Service is provided mainly by the Software.
VeloHound Service. VeloHound hereby grants You , non-exclusive, time-limited, non-transferrable, non-sub-licensable, revocable license to use the Service (including the Software) for non-commercial purposes, subject to these Terms. Access to the VeloHound software can be obtained trough a non-refundable one time fee or through a sponsored software.
USING THE SERVICE
You may use the Service solely for private and personal purposes. You must not use the Service commercially. For example, you may not offer to third parties a service of your own that uses the Service; you may not resell the Service, offer it for rent or lease, offer it to the public via communication or integrate it within a service of your own, without the prior written consent of VeloHound. You must not copy, print, save or otherwise use the data from the Site or the Service's database. This clause does not limit the use of the database as intended by the Software and for the purposes of private and personal use of the Service. When using the Service or the Site you may not engage in scraping, data mining, harvesting, screen scraping, data aggregating, and indexing. You agree that you will not use any robot, spider, scraper or other automated means to access the Site or the Serviceâ€™s database for any purpose without the express written permission of VeloHound. The Software may not be used in any way not expressly permitted by these Terms. Â
There are certain conducts which are strictly prohibited on the Service. Please read the following restrictions carefully. Your failure to comply with the provisions set forth below may result herein (at VeloHound's sole discretion) in the termination of your access to the Service and may also expose you to civil and/or criminal liability. You may not, whether by yourself or anyone on your behalf: (1) copy, modify, adapt, translate, reverse engineer, decompile, or disassemble any portion of the Content at the Service and/or Site, in any way or publicly display, perform, or distribute them; (2) make any use of the Content on any other website or networked computer environment for any purpose, or replicate or copy the Content without VeloHound's prior written consent; (3) create a browser or border environment around the Content (no frames or inline linking); (4) interfere with or violate any third party or other user's right to privacy or other rights, including copyrights and any other intellectual property rights of others, or harvest or collect personally identifiable information about visitors or users of the Service and/or Site without their express consent, including using any robot, spider, site search or retrieval application, or other manual or automatic device or process to retrieve, index, or data-mine; (5) defame, abuse, harass, stalk, threaten, or otherwise violate the legal rights of others, including othersâ€™ copyrights, and other intellectual property rights; (6) transmit or otherwise make available in connection with the Service and/or Site any virus, worm, Trojan Horse, time bomb, web bug, spyware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component; (7) interfere with or disrupt the operation of the Service and/or Site, or the servers or networks that host the Service and/or Site or make the Service and/or Site available, or disobey any requirements, procedures, policies, or regulations of such servers or networks; (8) sell, license, or exploit for any commercial purposes any use of or access to the Content and/or the Service and/or Site; (9) frame or mirror any part of the Service and/or Site without VeloHound prior express written authorization; (10) create a database by systematically downloading and storing all or any of the Content from the Service and/or Site; (11) forward any data generated from the Service and/or Site without the prior written consent of VeloHound; (12) transfer or assign your accounts' username, even temporarily, to a third party; (13) use the Service and/or Site for any illegal, immoral or unauthorized purpose; (14) use the Site, the Service, the Content and/or for non-personal or commercial purposes without VeloHound express prior written consent; or (15) infringe or violate any of the Terms.
REGISTERING TO THE SERVICE
TERMINATION OF USE OF THE SERVICE
You may terminate your use of the Service at any time and for whatever reason. You are not obligated to advise VeloHound of such termination. If you wish to remove personally identifying details from VeloHound's servers, please contact email@example.com. VeloHound retains the right to block your access to the Service and discontinue your use of the Service, at any time and for any reason VeloHound deems appropriate, at its sole and absolute discretion. Additionally, We retain the right to share your personal information or information that pertains to you, with appropriate third parties, in the following circumstances: If during registration you have intentionally provided wrongful or erroneous information; If you engaged in any act that is harmful or may be harmful to VeloHound, or any third party, including but not limited to other users, VeloHound's suppliers or VeloHound's partners; If you used or attempted to use the Site or the Service for an illegal act, or an act that is seemingly illegal, or if your use of the Site or the Service allows, facilitates, assists or encourages the commission of such acts; If you have violated these Terms; If the sharing of information is required to satisfy an order or decree prescribed by a judicial or administrative authority; If the sharing of information is required for the purpose of detecting, preventing or otherwise addressing technical issues, security breaches, or instances of suspected wrongdoings of fraudulent nature. To the extent possible, We will advise you of your account termination.
VeloHound has the right, but not the obligation, to regulate content (which includes but is not limited to postings, text, code, images, video, binary files, ads, accounts, account information, flags, emails, messages and any other user communications (â€œcontentâ€) posted to, stored on or transmitted via VeloHound by any user (or any third party in any manner); to regulate conduct (including but not limited to any authorized or unauthorized access to or use of VeloHound) by any user (or any other third party in any manner); and to enforce the Terms, for any reason and in any manner or by any means that VeloHound, in its sole discretion, deems necessary or appropriate (including but not limited to automated and manual screening, blocking, filtering, exclusion from index pages, exclusion form search results, requiring the use of an application programming interface (API), requiring the use of a bulk posting interface, authorization, verification, and the deletion and/or termination of content, accounts and /or all or any use or access). VeloHound may in its sole discretion and without notice, start, stop or modify any regulation or enforcement measures at any time. VeloHound action or inaction to regulate content or conduct or to enforce against any potential violation of the Terms by any user (or any third party) does not waive VeloHoundâ€™s right to implement or not implement regulation or enforcement measures with respect to any subsequent or similar content, conduct or potential Terms violation. You also understand and agree that any action or inaction by VeloHound or any of its directors, officers, shareholders, members, employees, consultants, agents or representatives (collectively, â€œVeloHound Representativesâ€) to prevent, restrict, redress or regulate content, or to implement other enforcement measures against any content, conduct or potential Terms violation is undertaken voluntarily and in good faith, and you expressly agree that neither VeloHound nor any VeloHound Representative shall be liable to you or anyone else for any action or inaction to prevent, restrict, redress, or regulate content, or to implement other enforcement measures against any content, conduct or potential violation of the Terms. Although VeloHound Representatives may moderate content, conduct and Terms compliance on VeloHound at VeloHoundâ€™s discretion, VeloHound Representatives have no authority to make binding commitments, promises or representations to anyone that they or anyone else on behalf of VeloHound will â€œtake careâ€ of or â€œcorrectâ€ any alleged problem of complaint, or that they or anyone else on behalf of VeloHound will otherwise stop, cure or prevent any problem, content, or conduct or purported Terms violation from occurring or recurring. Accordingly, you further agree that any representation (oral or written) by any VeloHound Representative (or by anyone else acting on behalf of VeloHound or by anyone purportedly acting on behalf of VeloHound) that VeloHound (including but not limited to any VeloHound Representative, anyone else acting on behalf of VeloHound) would or would not prevent, restrict, redress or regulate content (including, without limitation, screen, block moderated, review, remove, terminate, delete, edit or otherwise stop, cure or exclude an content), or to implement other enforcement measures against any content, conduct or potential or purported Terms violation is superseded by this provision and is nonbinding and unenforceable. Specifically, you agree that VeloHound, VeloHound Representatives, and anyone else authorized to act on behalf of VeloHound shall in no circumstance be liable as a result of any representation that VeloHound, a VeloHound Representative or anyone else on behalf of VeloHound would or would not restrict or redress any content, conduct or potential or purported Terms violation. This paragraph may not be modified, waived or release except by a written agreement, dated and signed by VeloHoundâ€™s President and dated and signed by the individual or entity to whom the modification, waiver or release is granted. VeloHound also has the right in its sole discretion to limit, modify, interrupt, suspend, or discontinue any or all portions of VeloHound at any time without notice. VeloHound and VeloHound Representatives shall not be liable for any such limitations, modifications interruptions, suspensions or discontinuance, or any purported losses, harm or damages arising from or related thereto.
The Service allows all users of the Software to submit and post information and content ("Submissions" or "Content "), including safety reports and postings on the discussion board. You assume sole responsibility for your Submissions and for the consequences of posting them. VeloHound does not control, is not responsible for and makes no representations or warranties with respect to any user content. You are solely responsible for your access to, use of and/or reliance on any user content. You must conduct any necessary, appropriate, prudent or judicious investigation, inquiry, research and due diligence with respect to any user content. You are also responsible for any content that you post or transmit and, if you create an account, you are responsible for all content posted or transmitted through or by use of your account. Content prohibited from VeloHound includes but is not limited to: (1) illegal content; (2) content in facilitation of the creation, advertising, distribution, provision or receipt of illegal goods or services; (3) offensive content (including, without limitation, defamatory, threatening, hateful or pornographic content); (4) content that discloses another's personal, confidential or proprietary information; (5) false or fraudulent content (including but not limited to false, fraudulent or misleading responses to user ads transmitted via VeloHound); (6) malicious content (including, without limitation, malware or spyware); (7) content that offers, promotes, advertises, or provides links to posting or auto-posting products or services, account creation or auto-creation products or services, flagging or auto-flagging products or services, bulk telephone numbers, or any other product or service that if utilized with respect to VeloHound would violate these Terms or VeloHound 's other legal rights; and (8) content that offers, promotes, advertises or provides links to unsolicited products or services. You automatically grant and assign to VeloHound, and you represent and warrant that you have the right to grant and assign to VeloHound, a perpetual, irrevocable, unlimited, fully paid, fully sub-licensable (through multiple tiers), worldwide license to copy, perform, display, distribute, prepare derivative works from (including, without limitation, incorporating into other works) and otherwise use any content that you post. You also expressly grant and assign to VeloHound all rights and causes of action to prohibit and enforce against any unauthorized copying, performance, display, distribution, use or exploitation of, or creation of derivative works from, any content that you post (including but not limited to any unauthorized downloading, extraction, harvesting, collection or aggregation of content that you post). You agree to indemnify and hold VeloHound and VeloHound Representatives harmless from and against any third-party claim, cause of action, demand or damages related to or arising out of: (a) content that you post or transmit (including but not limited to content that a third-party deems defamatory or otherwise harmful or offensive); (b) activity that occurs through or by use of your account (including, without limitation, all content posted or transmitted); (c) your use of or reliance on any user content; and (d) your violation of the Terms. This indemnification obligation includes payment of any attorneys' fees and costs incurred by VeloHound or VeloHound Representatives.
VeloHound does not control, is not responsible for and makes no representations or warranties with respect to any user or user conduct. You are solely responsible for your interaction with or reliance on any user or user conduct. You must perform any necessary, appropriate, prudent or judicious investigation, inquiry, research and due diligence with respect to any user or user conduct. You are also responsible for your own conduct and activities on, through or related to VeloHound, and, if you use or transmit any data through the Service, you are responsible for all conduct or activities on, through or by use of the Service. You agree to indemnify and hold VeloHound and VeloHound Representatives harmless from and against any third-party claim, cause of action, demand or damages related to or arising out of your own conduct or activities on, through or related to VeloHound, and related to or arising out of any conduct or activities on, through or by use of VeloHound, if any. This indemnification obligation includes payment of any attorneys' fees and costs incurred by VeloHound or VeloHound Representatives. Always drive, ride and walk vigilantly according to road conditions and in accordance with traffic laws. it is strictly forbidden to send safety reports while driving, riding and walking. safety reports may only be sent after you have stopped your vehicle or bicycle or have stopped walking and are standing in a safe location and/or in an appropriate location permited by law.
It is forbidden to submit Content of a commercial nature (including advertising), unless such posts pertain to VeloHound, the Service, or VeloHound's products and VeloHound has approved them in advance. When you submit Content to be published by the Service, you must make sure it is lawful. Among others, and for illustrational purposes only, you may not submit the following: Content that is diminishing or infringing proprietary rights of others, including but not limited to copyrights and trademarks; Content that creates a risk to a person's safety, security or health; Content identifying other persons without obtaining their consent to the disclosure of their personally identifiable information, or pertaining to minors and identifying them, their personal information or their address and contact information; Content that is unlawful, defamatory, libelous or invades the privacy of others; Content that is harassing, offensive, threatening or vulgar; Content that is characterized by, or that encourages racism or unlawfully discriminates on the basis of race, origin, ethnicity, nationality, religion, gender, occupation, sexual orientation, illness, physical or mental disability, faith, political view or socio-economical class; Content that encourages conduct that would be considered a criminal offense, or gives rise to civil liability or other lawsuit; Content that promotes pyramid schemes, chain letters or disruptive commercial messages or advertisements, or anything else prohibited by law or under these Terms; Content that falsely expresses or implies that such content is sponsored or endorsed by VeloHound.
VeloHound may decline to publish, or immediately delete any Content you submitted, if you have violated these Terms or if you engaged in a commission or omission that is harmful or may be harmful to the Service, its users, VeloHound or any of its agents or affiliates. In such cases, VeloHound may also prevent you from posting additional Content on the Service. The provisions of this clause are additional to any rights afforded to VeloHound by any law.
RIGHTS IN CONTENT
When you submit Content to be published on the Service, you represent and warrant that: you own all intellectual property rights in the Content; that You are permitted to publish the Content and to permit VeloHound to publish the Content and exploit all intellectual property rights in and to the Submissions. VeloHound receives no ownership rights in and to the Content of your Submissions. However, by submitting user Submissions to VeloHound, you hereby grant VeloHound and the users of the Service an irrevocable, worldwide, perpetual, non-exclusive, royalty-free, sublicenseable and transferable license to use, copy, distribute, prepare derivative works, display in public and publicly perform the Content. The license granted to VeloHound in and to your Submissions is not limited to personal uses, but also extends to any commercial use, at VeloHound's sole and absolute discretion. Other users may only use your Content for non-commercial purposes, unless otherwise permitted in advance in writing by VeloHound (for the purpose of which you authorize VeloHound to be your agent). Â
EXAMINATION OF CONTENT
VeloHound may examine the Content before or after its publication, prevent publication of inappropriate or otherwise inadequate or erroneous Content, or remove such Content after its publication. VeloHound does not normally use its right to monitor Content and does so only in rare cases. VeloHound retains sole discretion to determine which Content will be published, the duration of its publication, its location, design and any other matter pertaining to the publication of Content within the Service. VeloHound does not guarantee that all Content will be published, in general or for any limited time. Content submitted by users for publication does not reflect the views of VeloHound. Publishing Content does not warrant its validity, reliability, accuracy, legality or it being up-to-date. Â
All intellectual property rights in and to the Site, the Service and its database, including copyrights, trademarks, industrial designs, patents and trade secrets â€“ are either exclusive property of VeloHound or exclusively licensed to VeloHound. The Service is protected by, among others, the United States and international copyright laws. Copying, distributing, publicly displaying, offering to the public via communication, transferring to the public, modifying, adapting, processing, creating derivative works, selling or leasing, any part of the Service, in any manner or means without the prior written consent of VeloHound, is strictly forbidden. "VeloHound", the VeloHound logo, and other trade and/or service marks are property of VeloHound and may not be used in any of the aforementioned means. The design of the maps of the Site and the Service is a protected work under copyright laws and all its intellectual property rights remain the exclusive proprietary of VeloHound. The Software license does not extend to the maps presented by the Software or to any mark, indicator, logo or notation embedded in the map display. You may not copy or print more than one copy of any data or material appearing on the Site, maps and discussion boards. VeloHound may protect the Service by technological means intended to prevent unauthorized use of the Service. You undertake not to circumvent these means. Without derogating VeloHound's rights under these Terms or under any applicable law, infringement of the rights in and to the Service will, in and on itself, result in the termination of all your rights under these Terms. In such an event, you must immediately cease any and all uses of the Service, and within your obligations to VeloHound, you undertake to do so. Apple. If you use the Service through an Apple device, then you agree and acknowledge that: (1) Apple, Inc. bears no duties or obligations to you under the Terms, including, but not limited to, any obligation to furnish you with Service maintenance and support; (2) You will have no claims, and you waive any and all rights and causes of action against Apple with respect to the Service or the Terms, including, but not limited to claims related to maintenance and support, intellectual property infringement, liability, consumer protection, or regulatory or legal conformance; (3) Apple and Appleâ€™s subsidiaries are third party beneficiaries of the Terms. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof. Export Control. You represent and warrant that: (1) your are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a â€œterrorist supportingâ€ country; and (2) you are not listed on any U.S. Government list of prohibited or restricted parties.
LIMITATION OF LIABILITY AND WARRANTY
VeloHound provides the service and content included therein for use on an "as is" and "as available" basis. they cannot be customized to fulfill the needs of each and every user. we disclaim all warranties and representations, either express or implied, with respect to the service, including, without limitation, any warranties of merchantability, and fitness for a particular purpose, features, quality, non-infringement, title, compatibility, performance, security or accuracy. Additionally and without derogating from the above clause, VeloHound disclaims any warranty for the accuracy of the maps, discussion boards presented in or by the Service. You agree and acknowledge that you assume full, exclusive and sole responsibility for the use of the Service and that the use of the Service is entirely at your own risk. You acknowledge that you must observe all traffic laws while using the Service. The information provided by the service is not intended to replace the information presented on the road. VeloHound exerts efforts to provide you with a high quality and satisfactory service. However, We do not warrant that the Service will operate in an uninterrupted or error-free manner, or that it will always be available or free from all harmful components, or that it is safe, secured from unauthorized access to VeloHound's computers, immune from damages, free of malfunctions, bugs or failures, including, but not limited to hardware failures, Software failures and Software communication failures, originating either in VeloHound or any of its providers. VeloHound, including its officers, directors, shareholders, members, employees, sub-contractors and agents will not be liable for any direct, indirect, incidental or consequential damage, or any other damage, and loss (including loss of profit and loss of data), costs, expenses and payments, either in tort, contractual, or in any other form of liability, arising from, or in connection with the use of, or the inability to use the service, or from any failure, error, or breakdown in the function of the service, or from any fault, or error made by our staff or anyone acting on its behalf, or from your reliance on the content of the service, including, without limitation, content originating from third parties, or from any communication with the service, or with other users on or through the service, or from any denial or cancellation of your user account, or from retention, deletion, disclosure and any other use or loss of your content on the service. in any event, your sole remedy will be limited to correcting such errors, or malfunctions, and in light of the relevant circumstances. Additionally and without derogating from the above clause, VeloHound will not be liable for any form of liability arising from your reliance on, or in connection with, the use of the content of commercial information posted on the Service. Such information may be presented on the Service maps, discussion boards or otherwise.
LINKS AND COMMERCIAL INFORMATION IN THE SOFTWARE
VeloHound may incorporate in the Service advertisements and/or information of commercial nature. The source of such information may originate from VeloHound or from third parties. If such information originates from third parties, VeloHound cannot guarantee its reliability or accuracy. It is underscored that the advertising of commercial content by VeloHound does not constitute a recommendation or encouragement to procure the goods or services advertised. Insofar as the Software includes links to services or applications not operated or managed by VeloHound, VeloHound will not be liable for any form of liability arising from your reliance on, or in connection with, the content of such services and applications or any information provided by them, including but not limited to its completeness, accuracy, correctness or it being up-to-date. VeloHound will not be liable for any direct or indirect damage, monetary or otherwise, arising from your use of or your reliance on the content of services you have accessed via links on the Software.
BREACH AND INDEMNITY
Without derogating from any applicable law, you agree to indemnify and hold harmless VeloHound and its employees, officers, directors and agents, in the event you have violated these Terms or have operated unlawfully with respect to the Service , such indemnity shall cover all expenses, payments, loss, loss of profits or any other damage, direct or indirect, monetary or non-monetary, incurred by VeloHound, its employees, officers, directors or agents, including but not limited to legal expenses and attorney fees.
MODIFICATIONS TO THE SERVICE AND SOFTWARE
VeloHound may, either partially or in its entirety and without being obligated to provide prior notice â€“ modify, adapt or change the Software, the Service's features, the user interface and design, the extent and availability of the contents in the Service and any other aspect related to the Service. You will have no claim, complaint or demand against VeloHound for applying such changes or for failures incidental to such changes.
TERMINATION OF SERVICE
VeloHound may, at any time, terminate the provision of the Service in its entirety or any part thereof, temporarily or permanently, at its sole discretion.
MODIFICATIONS OF THESE TERMS
VeloHound may modify these Terms from time to time. If fundamental changes are introduced, a notice will be posted in the updated version of the Software as well as on the Service's home page on the Site. Your continued use of the Service after the Terms have been modified signifies your assent to the updated Terms. If you dissent to the updated Terms or to any term within them, you must discontinue all further use of the Software.
GOVERNING LAW AND JURISDICTION
Any and all claims, causes of action or disputes (regardless of theory) between you and VeloHound arising out of or related to the Terms, VeloHound or content accessed through VeloHound shall be governed by the laws of the State of Texas without regard to conflict or choice of law principles. You and VeloHound agree that any such claims, causes of action or disputes shall be brought exclusively in courts located within Travis County, Austin, Texas, and you and VeloHound agree to submit to the personal, sole, and exclusive jurisdiction of such courts. You further agree that, regardless of any statute or law to the contrary, you must file any such claim or cause of action within one year after such claim or cause of action arose or be forever barred. If any provision of the Terms is found by a court of competent jurisdiction to be unenforceable, all other provisions of the Terms shall remain in full force and effect.
Should you desire to file any cause of action against VeloHound, arising out of or related to the VeloHound Software or Service, you must do so within one (1) year of the day you become aware of the cause of action. Failure to file a lawsuit within the aforementioned time-frame will bring about the permanent barring of the cause of action, and will constitute your complete and final waiving of the lawsuit. Â
ASSIGNMENT OF RIGHTS
You may not assign or transfer your rights in and to the Service, without the prior written consent of VeloHound. VeloHound may assign its rights in and to the Service to a third party at its sole and absolute discretion, provided that the third party undertakes VeloHound's obligations to you under these Terms. Â
NO LEGAL RELATIONSHIP
You may contact us concerning any question about the Service, through the channels listed on the "About" menu in the Software or through the "Contact Us" page on the Site (web address: www.VeloHound.com/Contact). We will make our best efforts to address your inquiry promptly.

PERSONAL INFORMATION THAT YOU PROVIDE
When you use the Services, VeloHound may ask you to provide certain contact and personal details, such as your age, gender, etc.. VeloHound will explicitly indicate the fields for mandatory completion. If you do not enter the requisite data in these fields, you may not be able to use the Services. Please note that the username you choose will be used to identify you when you register and/or use the Services. Your username will be included along with any information you submit for posting (such as maps, discussion boards and any other data). It will therefore be visible to others. You may prefer to remain anonymous. If you prefer to remain anonymous, you can set the Application not to expose your username. Please consult the configuration options of the Application for exact settings. The application give users the option to identify a â€œsafe zone.â€ A â€œsafe zoneâ€ is considered to be an area of about a quarter mile radius that the user may want the application to identify as a â€œsafe zone.â€ When the user identifies a â€œsafe zoneâ€ through the application, the application will warn the user that the location recorded by the cell phone or device is located within the previously identified â€œsafe zone.â€ It is up to the user to continue sending the safety report or not to submit the safety report. Further information may be collected when VeloHound exchange communications with you, for example, if you submit a request, contact VeloHound's support team, or report a violation to the abuse team.
PERSONAL INFORMATION THAT YOU SHARE
The Services are based on users' locations and submissions, including user submissions made directly to the Service or user submissions made to third party services (such as discussion forums and social networks) which interact with the Service upon such users' choice, all of which may include personal information such as username, age, gender, etc.. You may upload and share content, such as safety reports, with other users of the Services. The content that you submit is neither private nor confidential and you should not have any expectation of privacy with respect to it. Information you upload will be posted along with other personally identifiable information.. Therefore, you must exercise caution and common sense when submitting information. At the very least you should demonstrate the same degree of caution as when publishing personal information by means other than the Internet and cellular services. You can decide whether or not to upload content to the Services. However any content that you submit for posting, may be viewed by all users of the Services and by VeloHound. VeloHound may make certain content that you submit for posting, viewable to all Internet users. In any event (but except as detailed below with respect to information shared from your social network accounts according to your privacy settings for such social network accounts), your email address (if provided) will not be visible to others through any reports or user posts that you share or upload. VeloHound has no control over the conduct of any user, and disclaims all liability in this regard. Users are advised to carefully and thoroughly consider whether or not to make public or available any information and carefully examine all necessary details related to any communication with other users prior to any engagement or communication being made. Participating in any user's activities as a result, directly or indirectly, from using VeloHound, is entirely at your own risk. VeloHound is not a party to any agreement entered into between the users in any circumstances. The user has the sole and ultimate responsibility regarding compliance with all laws, regulation or any other duty. We do not accept any liability for any loss, damage, cost or expense that you may suffer or incur as a result of or in connection with your participation in any activity or event initiated, held or conducted by a user or a third party nor in connection to any agreement between the users or third parties, including any activity or event related in any way, directly or indirectly, the Services or the use thereof.
LOCATION BASED INFORMATION THAT WE COLLECT
Either as "Anonymous" user or using a username, when you use your mobile device to send a safety report, VeloHound collects the location of your mobile device and safety report information. VeloHound uses that information to provide you and other users with the Services. VeloHound may make further use of your location and safety report information by providing you information about sites, shops and other places and attractions in close vicinity. VeloHound may also use your location and/or safety report information to create aggregated anonymous data and to use such data in accordance with this policy (please refer to use of aggregated information chapter hereunder). VeloHound will make commercially reasonable efforts to permanently remove or obscure your identity from your location or safety report information that is used for aggregated purposes.
OPTING OUT OF LOCATION INFORMATION SERVICES BY UNINSTALLING THE APPLICATION
At all times you may uninstall the Application, by using the programs removal feature of your operating system. Following the uninstallation process, VeloHound will not be able to collect any further location based information. When a user accesses the app for the first time VeloHound the website generates a user record number. This user record number is stored in the user application until the application is deleted. Submissions are associated with this user record number. If the application is deleted, the user record number is deleted from the cell phone or device. If you wish to remove personally identifying details from VeloHound's servers, please contact firstname.lastname@example.org.

VeloHound collects information about the use of the Services. For example, VeloHound may record the frequency and scope of your use of the Services. Such data is usually automatically collected and stored among others in log files of the Services' computer servers.
To login, you must use your username that VeloHound allocated to you, or that you have selected. To use the Application you may use a username or use the application as â€œanonymousâ€. You are fully accountable for any use or misuse of the VeloHound application and personal details as a result of conveying your details to someone else.

Personal information such as username, age, gender, etc. that is provided by you when first accessing the application is stored by VeloHound. Only information provided by you when submitting a Safety Report will be made public through the VeloHound maps and discussion boards. The content that you submit is neither private nor confidential and you should not have any expectation of privacy with respect to it. Information you upload will be posted along with other personally identifiable information. Therefore, you must exercise caution and common sense when submitting information. At the very least you should demonstrate the same degree of caution as when publishing personal information by means other than the Internet and cellular services. If you find that the information on your account is not accurate, complete or updated, then you must make all necessary changes to correct it.
HOW DOES VELOHOUND USE AGGREGATED INFORMATION?
VeloHound may use anonymous, statistical or aggregated information to properly operate the Services, to improve the quality of the Services, to enhance your experience, to create new services and features, including customized services, to change or cancel existing content or service, and for further internal, commercial and statistical purposes. VeloHound may also use anonymous, statistical or aggregated information collected on the Services, by posting, disseminating, transmitting or otherwise communicating or making available such information to users of the Services, to the Services' providers, partners and any other third party.
VeloHound will retain location and safety report information for the duration it deems necessary for its reasonable business needs. Thereafter, your location and safety report information may be made anomimous.VeloHound may at all times review, retain and disclose any other information as VeloHound deems necessary to satisfy any applicable law, regulation, legal process or governmental request and VeloHound's needs and necessities. By doing so VeloHound does not either expressly or impliedly endorse, affirm or in any manner assume any responsibility for such communications.
VeloHound may permit, solicit or contract certain other companies to conduct advertising campaigns on the Services. The advertisements that you see when accessing the Services are redirected from the servers of those advertising companies and may be geographically or contextually targeted. Please note however that other VeloHound users are not allowed to use your contact details or our internal messaging account for commercial advertising purposes. If you have encountered any user generated advertising material, please inform us through the channels listed on the "About" menu in the Software or through the "Contact Us" page on the Site (web address: www.VeloHound.com/Contact ). VeloHound does not accept any liability for any loss, damage, cost or expense that you may suffer or incur as a result of or in connection with any user's advertising material. You may withdraw your consent via written notice to VeloHound or on the same manner as the advertising was transmitted to you. It is clarified that we are not responsible for the content of said advertisements and the products delivered or services rendered thereby by third parties and you irrevocably and unconditionally agree that shall not be held responsible or liable in connection thereof.
VeloHound considers information security to be a top priority. VeloHound implements systems, applications and procedures to secure your personal information, to minimize the risks of theft, damage, loss of information, or unauthorized access or use of information. However, these measures are unable to provide absolute assurance. Therefore, although VeloHound takes great efforts to protect your personal information, VeloHound cannot guarantee and you cannot reasonably expect that the VeloHound's databases will be immune from any wrongdoings, malfunctions, unlawful interceptions or access, or other kinds of abuse and misuse.
VeloHound may from time to time change the terms of this policy. Substantial changes will take effect 30 days after VeloHound has posted an initial notification on the Website's homepage or any other relevant web pages. Other changes will take effect 7 days after their initial posting on the Website. However, if VeloHound amends this policy to comply with legal requirements, the amendments will become effective immediately upon their initial posting, or as required. You agree to be bound by any of the changes made in the terms of this policy. Continuing to use the Services will indicate your acceptance of the amended terms.
